Yush Terms of Service

These Terms of Service govern access to and use of the Yush platform, including yushnow.com, app.yushnow.com, our web applications, reaction pages, dashboards, reports, content tools, APIs and related services (together, the Service).
The Service is provided by Yush Ltd, a company registered in England and Wales, with registered office at 3rd Floor, 86–90 Paul Street, London, England, United Kingdom, EC2A 4NE. (Yush, we, us, our).
Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. By accessing or using the Service, you agree to these Terms. If you use the Service on behalf of an organisation, you confirm that you have authority to bind that organisation.
These Terms are split into three sections:
- General Terms - provisions that apply to all visitors, account holders, Customers, Respondents and anyone else who accesses or uses the Service.
- Customer Terms - provisions that apply to organisations or individuals who create an account or Reaction Kit to capture, manage, analyse, publish or reuse responses through the Service (Customers).
- Respondent Terms - provisions that apply to people who submit emojis, option selections, ratings, comments, photos, email addresses or other responses through a Reaction Kit (Respondents).
1. Definitions
- Customer
- a person or organisation that creates an account, creates or manages a Reaction Kit, collects responses, accesses dashboards or reports, or otherwise uses Yush to capture, analyse, publish or reuse responses. This may include event organisers, brands, venues, agencies, programme teams, communities, institutions, public bodies, charities or businesses.
- Kit Owner
- the Customer account user who creates, owns or controls a particular Reaction Kit.
- Reaction Kit
- a response-capture setup created through Yush, including questions, prompts, QR codes, short URLs, branding, settings, public pages, live displays, dashboards, exports and reports.
- Respondent
- a person who submits a Response through a Reaction Kit.
- Response
- any emoji, option selection, rating, short text, comment, photo, image, email address, metadata or other material submitted by a Respondent through the Service.
- Reaction Content
- any Response that includes text, comments, photos, images, quotes, captions or other content capable of being displayed, exported, reused or published.
- Public Surface
- any public or semi-public page, gallery, live display, share card, social proof page, example page, report excerpt, embed, public API output or other part of the Service that may be visible to people other than Yush and the relevant Customer.
- Customer Materials
- logos, event details, prompts, questions, branding, uploaded images, organiser photos, instructions and other content provided by a Customer.
- Yush Materials
- the Service, software, templates, reports, designs, layouts, copy frameworks, generated assets, AI prompts, platform content, trade marks, branding and other materials owned or licensed by Yush.
- Usage Data
- technical, diagnostic, analytics and usage information relating to use of the Service, including feature usage, performance data, device/browser data, log data and aggregated or de-identified statistics.
- Demo Content
- demo, sample, illustrative, synthetic or AI-generated content that is not based on genuine Respondent Responses.
Section A - General Terms
2. The Service
Yush provides tools for creating Reaction Kits, capturing live responses, displaying responses, analysing responses, generating reports, creating shareable outputs and supporting response-capture workflows.
The Service may include self-serve software, managed services, assisted setup, deployment assets, AI-assisted features, public galleries, exports and reporting tools.
Some features may be in beta, experimental, manual, partially automated or subject to change. We may add, change, suspend or discontinue features at any time. Where a material change affects paid Customers, we will take reasonable steps to give notice.
3. Eligibility, accounts and security
The Customer account service is intended for businesses, organisations, sole traders, professionals, charities, institutions and other non-consumer users. If you create an account as a Customer, you confirm that you are acting for business or professional purposes and not as a consumer.
When you create an account with us, you guarantee that you are at least 18 years old and that the information you provide is accurate, complete and current at all times. Inaccurate, incomplete or obsolete information may result in suspension or termination of your account.
The Service is not directed to children under 13. Respondents must be at least 13 years old to submit Responses through the Service. If you are aged 13 to 17, you should only submit a Response where you have appropriate permission and the relevant Reaction Kit is suitable for your age group.
You are responsible for maintaining the confidentiality of your account and password, including restricting access to your computer, device and account. You accept responsibility for activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately if you become aware of any breach of security or unauthorised use of your account.
You may not use as a username the name of another person or entity, a name that is not lawfully available for use, or a name or trade mark that is subject to the rights of another person or entity without appropriate authorisation. You may not use any username that is offensive, vulgar or obscene.
Accounts are personal to the authorised user. Unless Yush expressly provides shared team functionality, you must not share account credentials between individuals.
4. Third-party sign-in, including Google Sign-In
If you choose to register or log in using a third-party authentication provider, such as Google, you authorise Yush to receive the account information made available by that provider, such as your name, email address and profile picture, in accordance with our Privacy Policy.
We use this information to create, secure and manage your Yush account, authenticate you, personalise your profile and provide the Service.
We do not access your Gmail, Google Drive, Google Calendar or other Google services unless we expressly ask for additional permission and you grant it. You can revoke Yush’s access through your Google Account settings, but doing so may affect your ability to log into your Yush account.

The following documents form part of these Terms where applicable:

- Cookie Policy
- Data Processing Addendum
- Acceptable Use and Content Rules, if published separately
- any order form, statement of work, subscription checkout terms or managed-services agreement agreed with Yush
If there is a conflict between these Terms and a signed written agreement with Yush, the signed agreement will prevail to the extent of the conflict.
6. Acceptable use
You must not use the Service to:
- break the law or infringe another person’s rights;
- submit, upload, publish or encourage unlawful, defamatory, discriminatory, harassing, abusive, obscene, exploitative or misleading content;
- submit or publish content that invades another person’s privacy;
- upload photos of people where you do not have the necessary rights, notices or permissions;
- collect sensitive personal data unless appropriate safeguards have been agreed;
- collect data from or about children without appropriate consent and safeguarding measures;
- create fake, misleading, incentivised-without-disclosure or manipulated responses;
- impersonate another person or misrepresent the source of a Response;
- interfere with the Service, scrape it, reverse engineer it, overload it, bypass security controls, bypass rate limits or misuse public response flows;
- use the Service to train competing models or build a competing service without our written permission.
We may suspend, remove or restrict content or accounts that breach these Terms or create legal, privacy, security, reputational or operational risk. We may apply rate limits, usage limits, spam controls, anti-abuse measures, CAPTCHA, temporary restrictions or other technical controls to protect the Service, other users, Respondents and Public Surfaces.
7. Content ownership and licences
You retain ownership of content you submit or upload to the Service.
You grant Yush a limited, worldwide, non-exclusive, royalty-free licence to host, store, copy, process, transmit, display, analyse, format, moderate, export and otherwise use your content as necessary to provide, secure, improve, support and promote the Service, subject to these Terms and our Privacy Policy.
Where content is submitted through a Customer’s Reaction Kit, you acknowledge that the relevant Customer may access and use that content according to the Reaction Kit settings, the notice shown at the point of submission, applicable permissions and applicable law.
Yush does not claim ownership of Respondent Responses or Customer Materials.
8. Public display and Yush marketing reuse
Reaction Kits are designed to create live and reusable proof. Unless a Customer has disabled public display or a particular Reaction Kit states otherwise, Responses may appear on Public Surfaces, including live reaction feeds, public galleries, share cards, reports, example pages, product demonstrations and social proof pages. Where live display or public gallery features are enabled, Responses may appear shortly after submission.
Email addresses and contact details collected through an email-capture, follow-up or opt-in field will not be intentionally displayed by Yush on Public Surfaces. However, if a Respondent includes personal contact details inside free-text comments, captions, photos or other Reaction Content, those details may be visible unless removed or redacted.
Yush will use reasonable steps to make the public nature of a Reaction Kit clear to Respondents at the point of submission, including where comments, photos or other identifiable content may appear on Public Surfaces or be reused by Yush as described in these Terms.
Subject to the notice shown at submission, our Privacy Policy and applicable law, Yush may use Responses and Reaction Content in its own marketing, case studies, sales materials, product examples, product demonstrations, social media, website pages and investor or stakeholder materials. This may include event name, Customer name, screenshots, quotes, photos, reaction patterns, public gallery excerpts and report excerpts.
Where content includes personal data, photos, identifiable people or potentially sensitive information, Yush will use reasonable care and may remove, anonymise, blur, crop, redact or restrict content where appropriate. Respondents and Customers may request removal of identifiable content by contacting support@yushnow.com.
9. Moderation and takedown
Yush may, but is not required to, monitor, review, remove, hide, restrict, blur, crop, redact, reformat or refuse content where we reasonably believe it breaches these Terms, infringes rights, contains personal data that should not be public, is unlawful, harmful, offensive, misleading, spam, fake or irrelevant, or creates safeguarding, privacy, reputational, security or legal risk, provided that any displayed or reused version is not materially misleading.
Customers are responsible for moderating their own Reaction Kits and Public Surfaces unless we have expressly agreed to provide moderation as part of a managed service.
Respondents or third parties may request removal of content by contacting support@yushnow.com with enough information to identify the relevant content.
10. Privacy, data protection and cookies
Our Privacy Policy explains how personal data is collected, used, shared and retained. Our Cookie Policy explains how we use cookies and similar technologies.
Customers and Yush may have different roles under data protection law depending on the feature and use case. In many cases, the Customer controls why Responses are collected and how they are used, while Yush provides the Service that processes those Responses.
Where Yush processes personal data on behalf of a Customer, the Data Processing Addendum forms part of these Terms unless a separate written data processing agreement has been agreed.
Customers must provide accurate notices to Respondents and must not configure, describe or use the Service in a way that misleads Respondents about how their Responses will be used.
11. Usage Data
Yush may collect and use Usage Data to operate, secure, monitor, analyse and improve the Service, develop new features, understand product performance and create aggregated or de-identified benchmarks, insights or statistics.
Yush will not publish Usage Data in a way that intentionally identifies a Customer or Respondent unless permitted by these Terms, the Privacy Policy, the relevant notice or a separate agreement.
12. AI-assisted features and Demo Content
The Service may use AI-assisted features to suggest questions, transcribe images, classify sentiment, extract themes, generate summaries, draft reports, create shareable outputs or support other parts of the response-capture workflow.
Some AI-assisted features may rely on third-party AI, transcription, image-processing, analytics or infrastructure providers, as described in our Privacy Policy, Data Processing Addendum or subprocessor information where applicable.
AI outputs may be incomplete, inaccurate, inappropriate, misleading or contain fabricated details. Customers are responsible for reviewing AI-generated outputs before relying on them, publishing them or sharing them with stakeholders.
Customers must not use AI-generated outputs in a misleading way or present them as definitive, independently verified findings unless that is accurate.
The Service may include Demo Content for testing, onboarding, examples, product demonstrations or illustrative purposes. Yush will take reasonable steps to clearly label Demo Content where it appears in the Service and could reasonably be mistaken for genuine Respondent Responses. Customers must not present Demo Content as genuine Respondent Responses or use it in a way that suggests it reflects real attendee, visitor, customer or audience feedback.
13. Intellectual property
Yush and its licensors own all rights in the Service and Yush Materials.
You must not copy, modify, sell, distribute, reverse engineer, decompile, scrape, reproduce or create derivative works from the Service or Yush Materials except as permitted by these Terms or agreed in writing.
Customers may use Yush-generated assets, QR codes, signs, posters, slides, scripts, share cards and reports for their own legitimate use of the Service, subject to these Terms and their plan limits.
14. Third-party services
The Service may integrate with or rely on third-party services such as hosting providers, analytics tools, payment processors, email services, AI services, storage providers, authentication providers, CRMs, event tools and monitoring providers.
We are not responsible for third-party services that we do not control. Use of third-party services may be subject to their own terms and policies.
15. Fees, subscriptions and payment
Some features are free. Some require a paid subscription, paid add-on, managed service fee or bespoke agreement.
Fees, billing periods, limits, renewals, cancellations and plan features will be shown at checkout, in an order form or in a separate written agreement.
Unless stated otherwise, subscriptions renew automatically until cancelled. You are responsible for cancelling before renewal if you do not want the subscription to continue.
Fees are non-refundable except where required by law or expressly agreed in writing. If payment fails, we may suspend, downgrade or restrict access after reasonable notice.
We may change pricing or plan features by giving reasonable notice.
16. Service availability, backups and support
We aim to provide a reliable Service, but we do not guarantee uninterrupted, error-free or always-available access.
The Service may be unavailable due to maintenance, updates, outages, third-party failures, security issues or events outside our control.
Customers are responsible for exporting and retaining copies of Responses, reports, share cards and other outputs they need. We take reasonable steps to protect data, but we do not guarantee that any content, Response, export, report or Reaction Kit will always be recoverable.
Support levels depend on your plan or written agreement.
17. Disclaimers
The Service is provided on an “as is” and “as available” basis.
The Service is not intended to be used as the sole basis for decisions affecting a person’s rights, benefits, employment, access to services, health, safeguarding, legal status or reputation, or for medical, legal, law-enforcement, statutory public-sector, employment grievance or similarly high-risk individual-level decision-making, unless expressly agreed in writing with appropriate safeguards.
We do not guarantee that:
- any Reaction Kit will achieve a particular response rate;
- Respondents will submit accurate, lawful or useful Responses;
- AI-generated outputs will be accurate, complete or free from fabricated details;
- reports, summaries or analytics will be suitable for any specific legal, funding, research, sponsor, investor, employment, public-sector or regulatory purpose;
- public galleries or social proof outputs will improve sales, attendance, sponsorship, funding or reputation.
18. Liability
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Nothing in these Terms affects any statutory rights that a Respondent may have as a consumer.
Subject to the above, Yush will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, business, goodwill, anticipated savings, data or opportunity, arising from or in connection with the Service.
Yush will not be liable for any loss arising from: (i) your inability to access or use the Service; (ii) conduct or content of any third party; (iii) content obtained from the Service; (iv) unauthorised access, use or alteration of your transmissions or content; or (v) Customer use, publication, export or reuse of Responses outside the Service, except to the extent caused by Yush’s breach of these Terms or applicable law.
For Customers, Yush’s total aggregate liability arising out of or in connection with the Service will not exceed the greater of: (a) £100; or (b) the fees paid or payable by the Customer to Yush in the 12 months before the event giving rise to the claim.
This liability cap does not apply to liability that cannot be limited by law.
19. Indemnity
You agree to indemnify Yush against claims, losses, damages, liabilities, costs and expenses arising from:
- your breach of these Terms;
- your unlawful use of the Service;
- your Customer Materials or Responses;
- your misuse of Reaction Content;
- your failure to obtain required notices, consents, permissions or rights;
- your infringement of third-party rights;
- your use of Yush outputs in a misleading, unlawful or non-compliant way.
20. Suspension and termination
You may stop using the Service at any time. Customers may cancel subscriptions according to the applicable plan terms.
We may suspend or terminate access if you breach these Terms, fail to pay fees, create legal or security risk, misuse personal data or use the Service in a way that may harm Yush, other users, Respondents or third parties.
On termination, we may delete or restrict access to account data and content according to our Privacy Policy, data retention rules and any applicable Data Processing Addendum. Termination does not affect rights and obligations that by their nature should continue, including payment obligations, licences already granted for permitted public materials, confidentiality, liability limits and indemnities.
21. Changes to these Terms
We may update these Terms from time to time. The latest version will be available on our website.
Where changes are material, we will take reasonable steps to notify Customers. Continued use of the Service after the effective date means you accept the updated Terms.
22. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales.
The courts of England and Wales will have exclusive jurisdiction, except where applicable consumer law gives you the right to bring proceedings elsewhere.

Section B - Customer Terms
These Customer Terms apply to Customers and Kit Owners. The Customer service is B2B/professional-use only. Respondents may be consumers, attendees, visitors, participants or members of the public.
24. Customer responsibility for Reaction Kits
Customers are responsible for the Reaction Kits they create and manage, including:
- the questions they ask;
- the context in which Respondents are invited to respond;
- the settings selected for public/private display;
- the lawful basis for collecting and using Responses;
- the accuracy of notices given to Respondents;
- the way Responses and Reaction Content are exported, published, shared or reused;
- moderation of public galleries and live displays;
- compliance with laws, venue rules, safeguarding duties and internal policies.
Yush may provide templates, suggested questions, prompts, scripts, checklists or AI-assisted recommendations. These are support tools only. Customers remain responsible for reviewing and approving their use.
25. Authorised users and account access
Each Customer must ensure that only authorised individuals access its account or Reaction Kits. Customers are responsible for managing access, removing users who no longer require access and ensuring that authorised users comply with these Terms.
Customers must not share credentials between individuals unless Yush has expressly enabled shared team functionality. If credentials are shared, the Customer remains responsible for all activity under the account.
26. Customer Materials
Customers confirm that they have all rights, licences, notices, consents and permissions needed to upload and use Customer Materials, including logos, photos, names, event details, prompts, questions, brand assets and organiser-uploaded images. Where Customer Materials include photos, images, names, likenesses or other information relating to identifiable individuals, the Customer confirms that it has obtained all necessary rights, notices, consents and permissions to upload, display, process and use those materials through the Service.
Customers grant Yush a licence to use Customer Materials to provide the Service, generate assets, display Reaction Kits, produce reports and support the Customer’s use of Yush.
27. Respondent notices and consent wording
Customers must not mislead Respondents about how Responses will be used.
Customers must not modify, obscure, override or contradict Yush’s required legal notices, privacy wording or consent language. Customers may edit event-specific prompts, friendly context text and operational instructions where the Service permits, but legal consent and privacy wording must remain controlled by Yush unless Yush approves otherwise in writing.
Where Yush allows Customers to choose intended use cases, privacy settings or permission options, Customers must choose settings that accurately reflect how they intend to use the Responses.
Customers must not use Responses beyond the notices, settings, permissions or lawful bases that apply to those Responses.
28. Public galleries, live displays and reports
Reaction Kits are public-gallery first by default unless the Customer changes the relevant settings or Yush configures the kit differently. Customers must make sure public display is appropriate for the event, audience and content being requested.
Customers may use public galleries, live displays, share cards, Proof Packs, exports and reports only in accordance with these Terms, the Privacy Policy, the relevant Reaction Kit settings, the notice shown to Respondents and applicable law.
Customers must review Reaction Content before using it in sponsor reports, funder reports, board packs, social media, advertising, public case studies or other external materials where there is a risk of misleading presentation, privacy breach, confidentiality breach or reputational harm.
29. Moderation, hiding and redaction
Customers may hide, remove, moderate, classify, tag or redact Responses where the Service permits and where doing so is lawful and appropriate.
Customers must not edit Respondent comments or photos in a way that changes their meaning. Customers may redact personal data, confidential information, profanity or unlawful material where necessary, provided the edited version is not misleading.
If Customers curate selected Reaction Content for public pages, reports or marketing, they must not present the curated selection as complete, representative or independently verified unless that is accurate.
30. Marketing reuse by Customers
Customers may use identifiable Reaction Content in marketing, advertising, social media, testimonials, case studies, sales decks, sponsor materials or public-facing promotional materials only where:
- the Respondent has been clearly informed through the submission flow or other appropriate notice;
- the relevant permission or lawful basis applies;
- any required third-party rights or permissions have been obtained;
- the content is not presented in a misleading way;
- any incentive, reward or material connection is disclosed where required.
31. Review authenticity, incentives and misleading content
Customers must not:
- submit fake Responses;
- ask staff, contractors, sponsors, speakers or connected parties to pose as ordinary Respondents without disclosure;
- selectively present Responses in a way that creates a misleading overall impression;
- suppress negative or critical Responses from aggregate results while presenting the results as representative;
- offer incentives that are conditional on positive, favourable or high-rated Responses, or fail to clearly disclose incentives, rewards or material connections where required;
- edit Respondent comments in a way that changes their meaning;
- use Yush to create fake or misleading reviews, ratings, testimonials or social proof.
Customers must take reasonable steps to prevent, identify and remove fake, misleading, unlawful, private or inappropriate content from Public Surfaces they control. Yush may apply automated, manual or risk-based checks to help detect fake, misleading, incentivised-without-disclosure, spam or manipulated Responses, but Customers remain responsible for how they solicit, curate and present Responses.
32. Photos, minors and sensitive contexts
Customers must not encourage Respondents to upload photos of other people unless the Respondent has appropriate permission.
Customers must not use photos showing identifiable people in public reports, social media, marketing or promotional materials unless appropriate notice and permissions are in place.
Customers must not knowingly invite or permit children under 13 to submit Responses through the Service.
Customers must use extra care with events or Reaction Kits involving children aged 13 to 17, vulnerable people, schools, youth groups, medical contexts, political activities, religious activities, trade union matters, employment grievances, health conditions, disabilities, racial or ethnic identity, sexuality or other sensitive contexts. In such cases, Customers must assess the legal and safeguarding risks, use appropriate notices and controls, and disable public display or photo capture where public reuse would be inappropriate.
Yush may refuse or suspend Reaction Kits that create unacceptable safeguarding, privacy or legal risk.
33. Respondent invitations and uploaded contact lists
The Service may in future allow Customers to upload contact lists, attendee lists or email addresses, or ask Yush to send invitations, reminders or follow-up messages on the Customer’s behalf.
Where this functionality is available, Customers are responsible for ensuring that they have a lawful basis to upload and use those contact details, that any required marketing consent or soft opt-in applies, that suppression and opt-out requests are honoured, and that the contact list is accurate and lawfully obtained.
Customers must not upload purchased, scraped, harvested or unlawfully obtained contact lists. Customers must not ask Yush to send direct marketing messages unless they have the necessary permissions and comply with applicable electronic marketing laws.
34. Data protection roles and Data Processing Addendum
For Customer-controlled Reaction Kits, the Customer will usually determine why Responses are collected and how they are used. In those circumstances, the Customer is normally the controller of Respondent personal data, and Yush processes that data on the Customer’s behalf as processor, except where Yush acts as an independent controller for its own purposes.
Yush may act as an independent controller for purposes such as account administration, billing, security, fraud prevention, platform analytics, legal compliance, service improvement and Yush marketing where permitted.
Where Yush processes personal data on behalf of a Customer, the Data Processing Addendum applies.
35. Customer data export and deletion
Customers may export Responses where their plan allows.
Customers are responsible for any exported data after export, including secure storage, access control, deletion, lawful reuse and compliance with Respondent rights.
If a Respondent asks Yush to delete or restrict a Response, Yush may delete, hide or restrict the Response and may notify the relevant Customer where appropriate. Customers must cooperate with reasonable requests relating to Respondent rights.
36. Managed services
Where Yush provides managed services, assisted setup, onsite support, reporting support or bespoke deliverables, the scope, fees, responsibilities, deadlines, assumptions and exclusions should be set out in an order form, statement of work or written agreement.
Unless expressly agreed, managed services do not include legal review, safeguarding assessment, insurance for the Customer’s event, public liability cover for the Customer, professional research validation, moderation of all content, or guaranteed response rates.
37. Customer indemnity
Customers agree to indemnify Yush against claims arising from:
- Customer Materials;
- Reaction Kit configuration;
- unlawful or misleading use of Responses;
- failure to obtain required consents, notices or permissions;
- misuse of photos or identifiable content;
- publication of fake, misleading or unlawful review information;
- breach of data protection, consumer protection, advertising, safeguarding or intellectual property laws.
Section C - Respondent Terms
These Respondent Terms apply to people who submit Responses through Yush. Respondents may be consumers, attendees, visitors, participants, employees, community members, students or members of the public, depending on the Customer’s Reaction Kit.
38. Submitting a Response
You may be invited to submit a Response by scanning a QR code, visiting a short URL or opening a Reaction Kit.
You usually do not need to create an account to submit a Response. Respondent use of the Service is free unless a Customer tells you otherwise outside Yush.
Your Response may include an emoji, option selection, rating, short text, comment, photo, image, email address or other information requested by the Customer.
You should not submit personal data, sensitive information or photos of other people unless you are comfortable doing so and have any necessary permission.
The Service is not intended for Respondents under 13. If you are under 13, do not submit a Response.
39. Public nature of Responses and Yush marketing use
Reaction Kits are designed to collect live reactions and turn them into public or reusable proof. Unless the Reaction Kit states otherwise, Responses and Reaction Content may appear in a public gallery, live display, share card, report, example page, product demonstration or other Public Surface. Where live display or public gallery features are enabled, Responses may appear shortly after submission.
Email addresses and contact details collected through an email-capture, follow-up or opt-in field will not be intentionally displayed by Yush on Public Surfaces. However, if you include personal contact details inside free-text comments, captions, photos or other Reaction Content, those details may be visible unless removed or redacted.
The submission screen should tell you when public display applies. If you do not want a comment, photo or other identifiable information to be shown publicly or reused by Yush, do not submit it, or contact support@yushnow.com to request removal.
Subject to the notice shown at submission, our Privacy Policy and applicable law, Yush may use your Response and Reaction Content in its own marketing, case studies, sales materials, product examples, product demonstrations, social media, website pages and investor or stakeholder materials.
40. Who can see your Response
Depending on the Reaction Kit settings and the notice shown when you submit, your Response may be visible to:
- Yush;
- the Customer that created the Reaction Kit;
- the Customer’s team, contractors, sponsors, funders, partners or stakeholders;
- other attendees or viewers of a public gallery or live display;
- people who receive reports, exports, share cards or public links.
Do not include anything in your Response that you do not want the relevant Customer or Yush to see.
41. Email capture
Some Reaction Kits may allow you to provide your email address, for example to receive a copy of your Response, get a link, receive follow-up information or opt into updates.
Email addresses collected through an email-capture, follow-up or opt-in field will not be intentionally displayed by Yush on Public Surfaces.
Providing your email to receive your Response does not automatically mean you agree to marketing emails. Marketing emails require a separate opt-in or another lawful basis.
42. Licence from Respondents
You retain ownership of your Response.
By submitting a Response, you grant Yush a worldwide, non-exclusive, royalty-free licence to host, store, process, analyse, display, transmit, reproduce, publish and use your Response as needed to provide, operate, maintain, analyse, improve and support the Service and make it available according to the relevant Reaction Kit settings, submission notice and these Terms.
You also grant the relevant Customer a licence to access, use, analyse, reproduce, display, export and share your Response according to the relevant Reaction Kit settings, submission notice and these Terms.
43. Your responsibilities as a Respondent
You must not submit content that:
- is unlawful, abusive, defamatory, discriminatory, obscene, harassing or threatening;
- infringes another person’s rights;
- contains someone else’s personal data without permission;
- includes photos of other people without permission;
- is fake, misleading or submitted on behalf of someone else without disclosure;
- contains confidential information;
- contains sensitive personal data unless the Reaction Kit clearly asks for it and explains why.
44. Removal and rights requests
You may request deletion, removal or restriction of a Response by contacting support@yushnow.com.
Because many Responses are submitted without an account, we may need information to identify the Response, such as the event name, approximate time, screenshot, response text, photo, email address used or response link.
Where we cannot reasonably identify your Response, we may be unable to delete it.
If your Response has already been exported, published or reused by a Customer, we may need to refer your request to the relevant Customer. We will take reasonable steps to remove or restrict content from Yush-controlled Public Surfaces where appropriate.
45. No payment for Responses
Unless expressly stated otherwise, you will not receive payment for submitting a Response, and you waive any right to royalties or compensation for permitted use of your Response.
If incentives, prizes or rewards are offered by a Customer, the Customer is responsible for explaining and administering them.
